![]() ![]() Girls were majorly barred from inheriting because it was believed that they could soon get married and join hands with their husbands from where their properties were. ![]() The main inheritable properties then were, land and livestock. Succession used to be straight forward and simple in the pre-colonial Kenya. This act of returning the dowry was symbolic of a complete end to the marriage. Divorce was also a factor in most of the communities whereby, if the girl child was married and divorced, she could not just automatically benefit from her late father's intestate estate but dowry had to be returned in some communities before she could be allowed to share the estate. For example matters of marriage in most communities in Kenya could determine whether or not a girl child could inherit her father's property and how much she could get. Various aspects of life dictate how communities choose to distribute the estate of a deceased person. ![]() Different communities do embrace different routines in the distribution of the estate. Succession processes have existed since time immemorial to provide guidance on what is to become of a deceased person's property after their demise. The term succession means the acquisition of rights or property by inheritance under the laws of descent and distribution. ![]()
